Nona Technologies S.L. ("Nona," "we," "us," or "our") operates the Nona platform, accessible via : 

By registering as a user or using our platform, you agree to these Terms and Conditions and our Privacy Policy. "Platform" refers to both the Nona mobile application and website. "User," "you," and "your" refer to you, the individual using Nona.

Please read these terms carefully before using our services.

 

1. Acceptance of Terms

By accessing or using Nona, whether as a "visitor" browsing the platform or as a "user" registered as a Provider or Buyer, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately.

We may update these terms periodically. Continued use after any changes signifies your acceptance of the new terms. It is your responsibility to review these Terms regularly.

 

2. Eligibility

  • Age Requirement: Users must be at least 18 years old. Registration is restricted to individuals who can form a binding contract under applicable laws.

  • Account Verification: Nona reserves the right to verify user information during registration. Users previously removed from the platform cannot re-register.

  • Authority: By using Nona, you confirm that you have the authority to enter into this agreement and that your use complies with all applicable laws.

 

3. Services

A. Platform Overview

Nona is a marketplace connecting Buyers and Providers offering services in areas such as:

  • Babysitting

  • Housekeeping

Nona facilitates communication, invoicing, and payments between Buyers and Providers but does not directly provide these services. Providers are responsible for delivering their services, and Nona holds no liability for the quality or compliance of these services.

B. User Roles

Providers

  • Registration: Providers must register and provide accurate information about their services.

  • Service Offering: Providers list their services with detailed descriptions.

  • Reputation Building: Deliver high-quality services to receive positive reviews.

  • Payment Handling: Providers issue invoices post-service, and payments are processed through the platform.

Buyers

  • Service Search: Buyers can browse and compare services, prices, and reviews.

  • Booking: Services can be booked up to 14 days in advance.

  • Information Provision: Buyers must provide accurate details to facilitate service delivery.

  • Invoice Approval: Buyers have 10 days to review and accept invoices.

C. How It Works

For Providers

  1. Advertise Services: Clearly describe your services to attract Buyers.

  2. Respond Promptly: Address inquiries and booking requests in a timely manner.

  3. Maintain Quality: Provide consistent, high-quality services to build a strong reputation.

  4. Invoice Submission: After service completion, submit invoices through the platform for payment processing.

For Buyers

  1. Find Services: Use the platform to find and compare available services.

  2. Book Services: Schedule services within the 14-day booking window.

  3. Manage Transactions: Communicate with Providers and approve invoices upon service completion.

 

4. Account Management

A. Account Registration

  • Information Required: Name, address, mobile number, age, and a valid payment method.

  • Accuracy: Users must maintain up-to-date and accurate account information.

  • Security: Users are responsible for safeguarding their account credentials.

  • Single Account Policy: Each user may only hold one account unless otherwise permitted in writing by Nona.

B. Buyer Conduct

  • Authorized Use: Only the account holder may use the account; third-party use is prohibited.

  • Legal Compliance: Users must comply with all applicable laws when using Nona.

  • Prohibited Activities: Users must not engage in activities that cause nuisance, annoyance, or property damage.

C. Acceptable Use

  • Personal Use: The platform is intended for personal, non-commercial use unless otherwise agreed.

  • Lawful Purposes: Users must use Nona services for lawful activities only.

  • Respectful Interaction: Users must treat Providers and other users with respect and professionalism.

D. Account Deactivation and Suspension

  • Suspension Rights: Nona may suspend or deactivate accounts for violations of these terms or unauthorized use.

  • Appeals: Users may appeal suspension decisions within 14 days by contacting [email protected].

  • Post-Suspension Restrictions: Users cannot create new accounts if their previous accounts were suspended or terminated.

 

5. Cancellation and Refund Policy

A. Cancellations by Buyers

  1. Free Cancellation: Cancel or reschedule at least 24 hours before the service start time for a full refund, including Nona's fees.

  2. Late Cancellation: Cancel within 24 hours prior to the service start time; a fee equal to 3 hours of service at the Provider's rate applies.

  3. Free Cancellations Limit: Up to five free cancellations per year. Beyond that, a 20% penalty of the last canceled booking applies.

  4. Provider No-Show: If a Provider fails to show up without notice, Buyers receive a full refund.

  5. Provider Cancellation: If a Provider cancels, Buyers receive a full refund.

  6. Early Completion by Provider: No refund is provided if services are completed earlier than scheduled.

  7. Buyer No-Show: Buyers who do not show up or cancel within 1 hour of the scheduled time are charged as if the service was completed.

  8. Failure to Provide Access: Buyers failing to provide necessary access or information incur a fee equal to 3 hours of service plus Nona's fees.

  9. Unforeseen Circumstances: Buyers must notify Providers of emergencies promptly. Providers may reschedule or apply a reduced penalty.

  10. Change in Completion Time: Requests for early completion reflect the new service time in the invoice.

  11. Unreasonable Conditions: No refunds for changes in working conditions, location, or job description post-confirmation.

B. Cancellations by Providers

  1. Commitment: Providers canceling three times within six months face a six-month suspension.

  2. Late Arrival: Buyers may request compensation for late arrivals, rounded to the nearest 15 minutes.

  3. Provider No-Show: Providers failing to attend without notice have their accounts blocked for six months.

  4. Early Completion by Provider: No refunds for unused time if services are completed early.

  5. Emergency Cancellations: Providers must notify Nona and Buyers promptly in emergencies. Nona may offer rescheduling or apply penalties.

  6. Repeated Cancellations: Three cancellations within six months result in account suspension for six months.

 

6. Payments, Payouts, and Commissions

A. Payments

  1. Booking Charges: Buyers pay at the time of booking, including the Provider's hourly rate and Nona's commission.

  2. Invoice Processing: Providers submit invoices post-service. Buyers have 10 days to accept, reject, or request modifications.

  3. Automatic Acceptance: Invoices not addressed within 10 days are automatically accepted, and funds are released to Providers.

  4. Disputes: Disputes must be raised within 10 days by contacting [email protected]. Nona's decision is final.

B. Payment Methods

Payments are processed through:

  • Credit/Debit Cards: Visa, MasterCard, Discover, Amex, Diners, etc.

  • Payment Processor: Stripe securely handles transactions.

C. Commissions

  • Commission Rates: Vary based on job value and location, disclosed at booking.

  • Inclusion: Commission is added to the total service fee at booking time.

D. Payouts

  • Provider Payments: Funds are released to Providers via Stripe after Buyers accept invoices.

  • Withdrawal: Providers can withdraw funds through Stripe according to available options.

Payment Terms

  1. Payment Processing: All payments made by clients for services rendered through the Nona platform will be processed securely via Stripe, a trusted third-party payment processor.
     

  2. Payment Receipt: Providers will receive payment for completed services only after the client has paid the invoice through the Stripe payment system. The payment will be processed and deposited into the provider's nominated account, subject to the applicable fees charged by Stripe.
     

  3. Payment Timing: Payments will typically be transferred to the provider's account within 5-7 business days after the client has completed their payment (Please be aware that the first payment may take longer to process due to security verification procedures). However, delays may occur due to Stripe’s processing times or any other unforeseen technical issues.
     

  4. Refunds: If a client requests a refund, it will be processed in accordance with Nona’s refund policy. Providers agree to cooperate in resolving any issues related to refunds or disputes with clients.
     

  5. Fees: Providers acknowledge that Stripe charges a processing fee for transactions, and these fees will be deducted before payment is transferred. Providers are responsible for any applicable taxes related to the payments they receive.

 

7. Community Guidelines

Users must:

  • Respect Others: Communicate courteously and professionally.

  • Avoid Prohibited Content: Do not post illegal, harmful, or copyrighted material.

  • Prevent Spam and Impersonation: No spamming or impersonating others.

  • Secure Data: Refrain from unauthorized data collection or distribution.

All submissions in Community Areas are public and attributed to your profile.

 

8. Copyright and Confidentiality

A. Copyright

All platform materials (names, logos, images, text, etc.) are protected by intellectual property laws. Users are granted a limited, non-commercial license to use the platform content as intended. Unauthorized use is prohibited.

B. Copyright Infringement

If you believe your copyright is infringed, contact us with:

  • Identification of the copyrighted work.

  • Location of the infringing material on the platform.

  • Your contact information.

  • A statement of good faith belief in the infringement.

  • Your signature.

C. Confidential Information

Users must protect Nona's confidential information and use it only as permitted. Unauthorized disclosure or use is prohibited and must be reported immediately.

 

9. Disclaimers, Limitation of Liability, and Indemnity

A. Disclaimer

The Nona platform and all services offered through it are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Nona disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The platform will meet your specific needs.

  • Services will be uninterrupted, timely, secure, or error-free.

  • Any information obtained through the platform is accurate or reliable.

  • The quality of any service purchased through the platform will meet your expectations.

B. Limitation of Liability

You acknowledge and agree that Nona provides the platform solely to facilitate connections between Buyers and Providers. Nona is not responsible for, and expressly disclaims any liability for, the acts or omissions of Providers or Buyers, including any disputes arising from their interactions.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, NONA TECHNOLOGIES S.L. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS (COLLECTIVELY, THE "NONA PARTIES") SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

  1. DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES—INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

    • YOUR USE OR INABILITY TO USE THE PLATFORM.

    • ANY INTERRUPTION OR TERMINATION OF THE PLATFORM OR SERVICES, WHETHER INTENTIONAL OR UNINTENTIONAL.

    • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR CONTENT.

    • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM.

  2. ANY LOSS, DAMAGE, OR INJURY RESULTING FROM INTERACTIONS BETWEEN BUYERS AND PROVIDERS, INCLUDING SERVICES PROVIDED THROUGH THE PLATFORM.

If it is determined that the Nona Parties are liable for damages despite the above exclusions, THE AGGREGATE LIABILITY SHALL NOT EXCEED:

  • IF YOU ARE A BUYER: The total fees paid by you to Nona in the 6 months prior to the date the claim arose.

  • IF YOU ARE A PROVIDER: The total payments received by you through Nona in the 6 months prior to the date the claim arose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you in full.

C. Indemnity

1. Indemnity Obligations : You agree to indemnify, defend, and hold harmless Nona Technologies S.L. ("Nona"), its affiliates, officers, directors, employees, agents, and partners (collectively, the "Nona Parties") from and against any and all liabilities, claims, demands, losses, damages, costs, and expenses, including but not limited to reasonable attorneys' fees, arising from or in connection with:

  • Your Use of the Platform: Including any inability to use the platform, participation in any services, or any action taken via the platform.

  • Your Breach of the Terms: Any violation of these Terms and Conditions, including any representations or warranties made by you.

  • Violation of Law or Rights: Any breach of applicable laws, or the rights of any user, third party, or entity.

  • Third-Party Websites: Your use of or interactions with any third-party links or websites accessible through the platform.

  • User-Generated Content: Any content, feedback, or materials you submit to the platform, including those that may infringe upon intellectual property rights or be otherwise unlawful.

  • Acts of Your Representatives: Any actions or omissions by your agents, employees, contractors, or other individuals acting on your behalf.

2. Buyer Indemnification : If you are a Buyer, you shall indemnify, defend, and hold harmless Nona and its affiliates from and against any and all liabilities incurred in connection with:

  1. Your Use of the Platform: Including your participation in the booking process and your interaction with Providers.

  2. Your Breach of the Terms: Any violation of these Terms and Conditions, or any representations or warranties made by you.

  3. Violation of Law or Third-Party Rights: Your violation of applicable laws or the rights of any Provider, user, or third party.

  4. User-Generated Content: Content submitted by you, including reviews, feedback, or other materials that may infringe intellectual property rights or violate laws.

  5. Acts of Your Representatives: Any actions or omissions of individuals acting on your behalf in using the platform.

3. Provider Indemnification: If you are a Provider, you shall indemnify, defend, and hold harmless Nona and its affiliates from and against any and all liabilities incurred in connection with:

  1. Your Use of the Platform: Including your use of the platform to offer services or interact with Buyers.

  2. Your Participation in Tasks: Any issues arising from your ability or inability to perform services, complete tasks, or receive payment.

  3. Your Breach of the Terms: Any violation of these Terms and Conditions or representations made by you.

  4. Violation of Law or Third-Party Rights: Any violation of applicable laws or the rights of any Buyer, user, or third party.

  5. User-Generated Content: Content submitted by you or about you, including reviews, feedback, or other materials that may infringe intellectual property rights or violate laws.

  6. Acts of Your Representatives: Any actions or omissions of individuals acting on your behalf in providing services or using the platform.

4. Control of Defense : Nona reserves the right, in its sole discretion, to assume the exclusive defense and control of any matter otherwise subject to your indemnification. You agree that you will not settle any claim or matter without the prior written consent of Nona. If Nona assumes the defense, you agree to cooperate fully in defending any claim, and Nona shall bear all reasonable costs and expenses incurred in such defense.

 

 

10. Disputes

A. Between Users

Disputes between Buyers and Providers should be resolved directly. Nona may assist but is not liable for outcomes.

B. Arbitration

To expedite resolution and reduce the costs of any dispute, controversy, or claim related to or arising from your use of the Nona platform, your relationship with Nona, the services provided, or these Terms and Conditions (including any prior versions) ("Dispute"), we encourage you to first attempt to resolve the matter amicably with Nona before seeking any out-of-court settlement or initiating formal legal proceedings. Any disputes related to these Terms or platform use shall be resolved through binding arbitration in Spain, excluding class actions.

 

11. Personal Data

13. Miscellaneous

A. Choice of Law

These Terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in Spanish courts.

B. General

  • Assignment: Users cannot assign these Terms without Nona's written consent. Nona may assign rights as outlined.

  • Severability: If any provision is invalid, the remaining Terms remain in effect.

  • No Waiver: Nona's failure to enforce any provision does not waive future enforcement.
